Terms and Conditions

1. Scope

These Terms and Conditions apply to all contracts between Jens Freudenau, LucidSeo, Eisenacher Straße 66, 10823 Berlin (hereinafter "Provider") and the users of the LucidSEO service at https://lucidseo.net (hereinafter "Users").

2. Description of Services

LucidSEO is an AI-powered API service for the automated analysis of images. Based on uploaded images, the service generates alt text, captions, meta descriptions and keywords for SEO purposes. The service is aimed at professional photographers, agencies and developers.

The API is accessible via a personal API key, which is provided upon taking out a paid subscription or as part of the free plan.

3. Conclusion of Contract

The contract is concluded upon registration on lucidseo.net and the selection of a plan. For paid plans, the contract is concluded upon completion of the payment process via the payment service provider Stripe.

4. Plans and Prices

The current plans and prices can be viewed at lucidseo.net/price. All prices include VAT, unless otherwise stated.

Paid subscriptions are billed monthly in advance and are automatically renewed unless cancelled in due time.

5. Payment

Payment is processed via the payment service provider Stripe. Available payment methods (including credit card, SEPA direct debit, Apple Pay and Google Pay) are displayed at checkout and may vary depending on region and device. In the event of a failed payment, the provider reserves the right to block access to the service.

6. Term and Termination

Subscriptions run for an indefinite period and may be cancelled at any time with effect from the end of the current billing period. Cancellation is effected via the "Billing" section of the user account or in writing by email to contact@lucidseo.net.

Following cancellation, the user retains access to the service until the end of the paid period. Thereafter, the account is automatically downgraded to the free plan.

7. Right of Withdrawal

Consumers are generally entitled to a 14-day right of withdrawal. The right of withdrawal expires in the case of digital content as soon as performance of the contract has begun and the user has previously expressly agreed that the provider may commence performance, and has confirmed their awareness that, by giving their consent, they lose their right of withdrawal upon the commencement of performance of the contract.

9. Availability

The Provider endeavours to ensure high availability of the Service, but does not guarantee uninterrupted availability. Maintenance work will be carried out outside peak usage times where possible.

10. Limitation of Liability

The Provider shall be liable without limitation in cases of intent and gross negligence, as well as in the event of injury to life, limb or health. In all other respects, liability is limited to foreseeable damage typical for this type of contract. Liability for the accuracy, completeness or suitability of the content generated by the AI (alt text, keywords, etc.) is expressly excluded.

12. Amendments to the Terms and Conditions

The Provider reserves the right to amend these Terms and Conditions with reasonable notice (at least 30 days). If the User does not object to the amended Terms and Conditions within this period, the amended terms shall be deemed accepted.

13. Applicable Law and Jurisdiction

The law of the Federal Republic of Germany applies. The place of jurisdiction is Berlin, provided that the user is a trader, a legal entity under public law or a special fund under public law.
